Insolvency practitioners
A substantial part of our recovery practice comes from liquidators, administrators and trustees. We act on voidable transaction and director-related claims, public examinations, tracing and freezing applications, and recoveries against directors, advisers and related entities, in Australia and cross-border. We also act for creditors and creditor groups pursuing recoveries in external administrations.
We understand the position practitioners are often in: the estate may hold real claims, but limited or no funds with which to understand them. Our capped-cost claim-viability review addresses that directly. Within an agreed budget, we examine the books, the transactions and the recoverability of targets, and report on which claims are worth running, in a form you can put before a committee, a court or a funder. If the answer is none, we say so.
Where claims are viable, we work with practitioners on terms that reflect the estate’s position: staged fees, deferred arrangements, or alongside litigation funders. We are prepared to share in the risk where the claims justify it.
Investigation firms
The relationship runs both ways: investigation firms refer clients to us, and we brief investigation firms on our own matters, directing their work so that, where the law allows, it is protected by privilege.
We are a law firm. We do not conduct commercial investigations, and we do not compete with the firms that do. When your client needs freezing orders, recovery proceedings or a referral prepared for police, we act as the conflict-free legal counterpart: your client relationship stays yours, and we work with you from the outset so that what you have found arrives in court in admissible form.
Law firms and insurers
When your firm acts for a company that is sued or under investigation, you often cannot also act for its directors and officers. We provide separate representation for the individuals: independent, coordinated with you where interests align, and conflict-free. We have no institutional client base to protect. We also take conflict referrals and specialist briefs in our field, appear as independent supervising solicitor on search orders, and act for insurers on fidelity and fraud claims. Referred clients are returned when the specialist work is done.
